			<content:encoded><![CDATA[<p><strong>surrender to custody</strong> To give oneself into the custody of the court or police at</p>
<p>an appointed time and place. It is the primary condition of all releases on *bail to</p>
<p>surrender to custody; in order to achieve this, the court may attach conditions to</p>
<p>the bail, such as the provision of a *surety or restrictions on movement. Failure to</p>
<p>surrender to custody is an offence <em>(see</em> <a href="absconding-definition-absconding-defined-2-78.html">ABSCONDING</a>).  The police may arrest without</p>
<p>warrant anyone whom they reasonably believe is not going to surrender to custody</p>
<p>or anyone whom they have been informed by a surety (who wishes to be relieved of</p>
<p>his undertaking) is not going to surrender.</p>
